kurzgesagt Loyalty Program Terms & Conditions
These terms and conditions (“Terms”) govern the kurzgesagt loyalty program (“Program”) operated by in a nutshell – kurzgesagt GmbH, Landwehrstraße 39, 80336 Munich, Germany (“kurzgesagt”, “we”, “us” or “our”). By joining the Program, you (“Member”) agree to be bound by these Terms. Please read them carefully before joining.
2. Joining the Program
2.1 If you create a new Online Shop Account after the start of the Program, membership to the Program is voluntary and requires your active enrolment by confirming the respective opt-in during the creation of your Online Shop Account. You are not enrolled automatically.
2.2 Holding an Online Shop Account before the start of the Program, you automatically become a Member if you do not opt-out by communicated means. Following such amendment, you shall continue to have the right to terminate your membership to the Program at any time in accordance with Sec. 10. If you opt-out, your Online Shop Account remains unaffected. You may join the Program at a later date at any time by getting in touch with customer support in accordance with Sec. 12.
2.3 You may use your Online Shop Account, place orders and use all store functions without joining the Program.
3. Earning Points
3.1 Members may earn points (“Points”) for qualifying orders in the Online Shop and for other qualifying activities (“Qualifying Activity”). Qualifying Activities, the number of Points awarded, and any limits or conditions shall be determined in accordance with the overview available on the Loyalty Program page as in effect at the time of the respective Qualifying Activity. We may add, change, or withdraw Qualifying Activities and Point values at any time at our reasonable discretion; the rules in force are those published on the Loyalty Program page (“Applicable Loyalty Program Page”).
3.2 Points are assigned automatically and are credited to the respective Online Shop Account once the respective Qualifying Activity has been confirmed. Points awarded for a Qualifying Activity may be shown as pending until the applicable return period (for a qualifying order) has elapsed.
4. Membership Tiers
4.1 The Program may include membership tiers. Members are placed in a tier according to the total Points they have earned; redeeming Points do not reduce a Member’s tier status. The tiers, the thresholds required to reach them, and the associated benefits shall be determined in accordance with the overview available on the Applicable Loyalty Program Page; Sec. 3.1 last sentence shall apply accordingly.
4.2 A Member may be moved to a lower tier after a continuous period of inactivity, as stated on the Applicable Loyalty Program Page. We will notify the Member in an appropriate manner and with reasonable advance notice before any tier demotion takes effect.
5. Redeeming Rewards
5.1 Points may be redeemed for rewards, discounts, or other benefits (“Rewards”) as published on the Applicable Loyalty Program Page; Sec. 3.1 last sentence shall apply accordingly.
5.2 Rewards are subject to any further conditions stated at the time of redemption. Unless stated otherwise, Rewards cannot be combined with other Rewards, vouchers, or discount codes, and no cash alternative is available.
6. Value and Expiry of Points
6.1 Points have no monetary value. They are not property or legal tender and may not be sold, transferred, exchanged for cash, refunded, or otherwise compensated. This applies in all circumstances, including the closure of a customer account and any change to or discontinuation of the Program. Points may be used only to redeem the Rewards offered within the Program.
6.2 Points may expire as set out on the Applicable Loyalty Program Page. If new expiration periods are introduced with future effect, Members will be informed thereof in an appropriate manner and with reasonable advance notice.
7. Returns, Cancellations, and Adjustments
7.1 Where Points were awarded for a Qualifying Activity (in particular, a qualifying order) that is subsequently cancelled, returned, refunded, or charged back, the corresponding Points will be deducted from the Member’s balance. Where an order is partly returned and the related Reward was not used with that order, the Points are removed in proportion to the items returned.
7.2 Where a Reward was applied to a Qualifying Activity (in particular, a qualifying order) that is later returned, the return is handled in accordance with our general returns policy in our ToS (EU and US).
8. Changes to the Program and these Terms
8.1 We may amend these Terms or modify the Program (including earning rules, tiers, and Rewards) at any time for a valid reason, such as a change in applicable law, in the features of the Program, or in our service provider. We will give reasonable advance notice of material changes by email or via the Applicable Loyalty Program Page.
8.2 We reserve the right to permanently discontinue, revise, or modify the Program at any time. If we discontinue the Program, Members will be informed thereof in an appropriate manner and with reasonable advance notice and we give them a reasonable period in which to redeem their accrued Points before they lapse.
9. Leaving the Program; Suspension and Termination
9.1 You may leave the Program at any time by contacting us. On leaving the Program, any unredeemed Points are forfeited.
9.2 If you close or delete your Online Shop Account (for example, through a request to erase your personal data), your loyalty profile is removed and any unredeemed Points are forfeited.
9.3 We may suspend or terminate a membership and withhold, cancel, or reverse Points and Rewards where we reasonably suspect fraud, abuse, or manipulation of the Program, or a material breach of these Terms or of our ToS (EU and US).
10. Data Protection and Program Communications
10.1 We process personal data relating to your participation in the Program in accordance with our Privacy Notice, available at https://shop-eu.kurzgesagt.org/pages/loyalty-privacy-notice. Joining the Program is optional and is not a condition for purchasing from us or for holding an Online Shop Account.
10.2 As a Member, you may receive Program-related communications (for example, about new or expiring Rewards or tier changes), which are sent via our email service provider. You can unsubscribe at any time using the link in each email or by contacting us.
11. Governing Law, Language, and Severability
11.1 These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected.
11.2 These Terms are issued in English, which is the governing language of the Program.
11.3 Should any provision of these Terms be or become invalid, the validity of the remaining provisions is unaffected.
11.4 We are not obligated and not willing to participate in dispute resolution proceedings pursuant to the German Consumer Dispute Resolution Act (VSBG).
