Human Era Calendar Giveaway Terms & Conditions of Entry

The competition organizer is In a Nutshell – Kurzgesagt GmbH, Landwehrstrasse 39, 80336 Munich, Germany – hereinafter the ‘organizer’. These terms and conditions of entry govern the participants’ entry into the organizer’s competition as well as the collection and use of the data supplied by the entrants.

The organizer is giving five entrants per shop the chance to win a coupon code equivalent to the value of one 12,027 Human Era Calendar, redeemable for one 12,027 Human Era Calendar from the kurzgesagt EU or US shop in accordance with the following terms and conditions.

By entering the competition, the entrant agrees to the following terms and conditions.

1. What can be won?

Competition entrants have the chance to win 1 of 5 voucher(s) equivalent to the value of one 12,027 Human Era Calendar, redeemable for one 12,027 Human Era Calendar from the kurzgesagt EU or US shop in accordance with Section 9.

2. How does the competition work?

Entrants are asked to submit a photograph of their current Human Era Calendar in accordance with Section 5 of these terms and conditions via the entry form at: https://tally.so/r/ODxY2g, together with their email address. Entry is free and requires no purchase. 

Entries submitted by any other route including post, email, direct message, or social media comment will not be considered. A jury will select their favorite 5 entries per shop based on criteria such as clarity and creativity in accordance with Section 7. and communicate the winner(s) in accordance with Section 8.

3. When does the competition start and how long will it run for?

Entry is possible from Thursday 17th September 2026 until Thursday 24th September.

4. Who can enter?

Persons aged 18 or older are eligible to enter. Entry is limited to persons who are subscribed to the kurzgesagt newsletter at the time the competition is announced and submit a photograph in accordance with Section 5.  There is no entitlement to receive the invitation to the competition, if any, or to take part in the competition. 

Competition clubs and automated competition services are not eligible to enter. The organizer reserves the right to exclude individuals from the competition at any time if there are justified reasons for doing so (e.g. violating these terms and conditions of entry, manipulation) and further reserves the right to take legal action. Only one entry is allowed per person; anybody attempting to enter the competition more than once or supplying incorrect details will forfeit the right to enter the competition. If an entrant is excluded from the competition, a prize already awarded may be reclaimed and any voucher code already issued may be invalidated.

Employees of the organizer and their relatives as well as employees of the companies involved in this game and their relatives are not eligible to participate.

5. What are the requirements for submitted photographs?

Submitted photographs must show the entrant's own Human Era Calendar and must be of sufficient quality for digital publication (minimum 800px width). The organizer removes file metadata, in particular EXIF location data, from submitted photographs before any publication.

Submitted photographs must not contain:

  • any person who is identifiable, whether by their face or otherwise;
  • any other personally identifiable information, including but not limited to names, addresses, documents, screens displaying personal data, or identifiable house numbers or vehicle registration plates;
  • material that is unlawful, offensive, defamatory, discriminatory, or that infringes the rights of any third party;
  • any third-party trade marks or copyrighted works other than the kurzgesagt calendar itself.

The organizer reserves the right to exclude any entry that does not meet these requirements, at its sole discretion and without giving reasons. The organizer is under no obligation to review submissions for compliance and accepts no responsibility for content submitted in breach of these requirements. This does not affect the organizer’s own responsibility for photographs which it selects for publication.

6. Ownership of and rights in submitted photographs

By submitting a photograph, the entrant warrants that:

  • they took the photograph themselves and own all rights in it;
  • the photograph does not infringe the copyright, trade mark, personality, or other rights of any third party;
  • no person is identifiable in the photograph.

The entrant indemnifies the organizer against any third-party claims arising from a breach of these warranties. The entrant retains ownership of their photograph. By submitting a photograph, the entrant grants the organizer, without limitation in time, a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit (in particular crop, resize and colour-correct the photograph and combine it with other content, provided that the character of the photograph is not distorted), sublicense to service providers and to the operators of the platforms named below to the extent required for publication there, and publish the photograph in digital marketing and promotional materials relating to the 12,027 Human Era Calendar and the kurzgesagt EU or US shop. This includes:

  • the kurzgesagt shop website (EU and US);
  • kurzgesagt email newsletters;
  • kurzgesagt social media channels;
  • end cards and promotional segments within kurzgesagt YouTube videos.

The organizer will not use submitted photographs in printed materials or on any physical product. 

Photographs will be published without attribution. The organizer is under no obligation to use any submitted photograph.

For the avoidance of doubt, the licence granted under this Section 6. applies to all entrants, whether or not they win a prize.

7. How are the winners determined?

The winner(s) will be determined among all eligible entrants by a small panel of kurzgesagt employees appointed by the organizer (“jury”) that assesses the photo entries against the following criteria: clarity of the calendar, quality of photo, and creativity. The jury’s decision is final; enquiries in this respect cannot be answered.

8. How can I find out if I have won?

The winner(s) will be notified following the previously communicated termination date of the competition. They will be contacted via the email address provided in the entry form along with their voucher code.

9. How will I receive my prize?

An exclusive voucher code will be sent to the entrant’s email address provided in the entry form. This voucher code will remain redeemable for four (4) weeks from the date on which it is issued. If the 12,027 Human Era Calendar is sold out before the voucher has been redeemed within that period, the organizer will offer a product of equivalent value from the kurzgesagt shop instead. The prize cannot be paid out in cash or in the form of any other material goods, and cannot be transferred to another person. 

10. Reservation clause / Guarantee disclaimer

The organizer reserves the right to suspend or terminate the competition for good cause. Good cause shall be deemed to exist in particular if no guarantee can be given that the competition can be run in the due and proper manner due to force majeure, technical reasons (e.g. viruses in the computer system, manipulation or hardware and/or software errors) or legal reasons. The organizer assumes no liability for any losses, failures or delays caused by circumstances outside its area of responsibility. The organizer also accepts no responsibility for entries which do not reach it, for example as a result of technical faults or failures of hardware, software, networks or servers.

The organizer further reserves the right to amend an ongoing competition or the manner in which it is conducted where there is good cause to do so. Entrants affected by any such amendment will be informed without undue delay in an appropriate manner. Any prize claims that have already validly and irrevocably arisen shall remain unaffected.

11. Liability

Without prejudice to other statutory eligibility requirements, the following disclaimers and limitations of liability shall apply in relation to the organizer’s liability for any claims for damages. 

The organizer assumes full liability for any damage or loss caused by intent or gross negligence.

Furthermore, the organizer assumes liability for any slightly negligent breach of its fundamental obligations, the infringement of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which makes the proper organization of the competition possible in the first place and the adherence to which the contractual partner may generally rely on. In such cases, however, the organizer’s liability shall be limited to foreseeable damages typical of the contract. The organizer assumes no responsibility for the slightly negligent breach of obligations other than those detailed in the aforementioned sentences.

The aforementioned limitations of liability do not apply to the loss of life and injury to body or health, nor do they apply to any defects after providing guarantees in relation to the quality of a product and any fraudulently concealed defects. Liability for damages covered by the provisions of the Product Liability Act (Produkthaftungsgesetz) remains unaffected.

Insofar as the organizer’s liability is excluded or limited, this also extends to the personal liability of the organizer’s employees, representatives, and vicarious agents.

12. Data Protection

To the extent that personal data of entrants is collected in connection with the competition (email address, photographs if containing personal data, etc.), such data will be collected and processed by the organizer solely for the purpose of administering the competition in accordance with these terms and conditions, including in particular notifying entrants and delivering the prize. The data will be deleted after the prize draw has ended, unless a longer retention period is required for contractual or legal reasons (i.e., for using the licence for the photographs in accordance with Section 6.).

No further processing of entrants’ personal data will take place. In particular, personal data will not be disclosed to unauthorized third parties. Data may, however, be shared with designated partners or service providers of the organizer where this is necessary for the administration of the competition.

Any disclosure going beyond this takes place only where the entrant has expressly consented to it or where another legal basis for such disclosure has been expressly communicated.

13. Miscellaneous

If any provisions of the terms and conditions of entry should be (or become) invalid, the validity of the remaining terms and conditions of entry shall remain unaffected. An appropriate arrangement that most closely corresponds to the invalid provision shall take its place.

14. Final Provisions

The laws of the Federal Republic of Germany shall apply under the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law does not affect the application of mandatory consumer protection provisions of the law of the state in which the entrant has their habitual residence.

There is no legal recourse. The organizer is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
